I’ve been thinking a lot lately about two excellent books on very different topics, both of which I’ve written about at Love of All Wisdom before: Andrew Nicholson’s Unifying Hinduism, and Brian Tierney’s The Idea of Natural Rights.

The idea of human or natural rights has often been taken as something nearly eternal, dating back into antiquity. More careful scholarship, most notably that of Michel Villey, shows us it is not that. Villey takes the work of William of Ockham as a breaking point, a sharp rupture from the previous world that had no concept of rights, which brings in a very different metaphysics where rights now play an important role. The brilliance of Tierney’s work is to qualify this point, showing a gradual transition from the world before Ockham to the world after him. It preserves Villey’s basic point that rights do not go back to antiquity, but shows that the boundary between premodern and modern is much blurrier than previous scholarship had imagined.

Reasons for rights

We have seen over the past few posts that while the idea of individual rights is not just a modern invention, it also is far from a universal one. Rights are not obvious or commonsensical. Contra the American Declaration of Independence, they are not self-evident.

Rather, rights need reasons. If one wants to get to the truth of the matter (and not merely to achieve an expedient political deal), it is never good enough to say something should be done for, or not done to, a person “because he has a right to it”. The right itself requires a justification. Sometimes one’s interlocutor already agrees that the person has this right, but in many cases – the most important cases – they do not in fact agree.

This point is easy to lose sight of, perhaps especially in the contemporary United States where the opposing political sides rarely speak to each other. Each side insists it is defending rights: the employee’s right to contraception, Hobby Lobby‘s right to refuse to provide contraception on religious grounds, the fetus’s right to life, the woman’s right to an abortion. But what is in question here – assuming we acknowledge the existence of rights in the first place – is who has which rights. And then we need to provide reasons.

On Leif Wenar’s modern definition, a right is an entitlement. Historically, when William of Ockham articulated a concept of rights that would get increasingly taken up in the years following, it was a potesta licitas: a legal power, a power of licence. Key to a right is an entitlement or licence that implies an obligation of others to respect it.

Last time I began exploring the history of the concept of rights (as in human or civil rights), through the works of Michel Villey and Brian Tierney. I noted that the concept as we now understand it has its roots in Latin ius, which had a meaning more like law and one’s proper share than like rights. How did this concept become the concept of individual rights that we now have today?

I will be taking a break from blogging over the next few weeks’ holiday. When new posts return in January, they will be on a biweekly (or fortnightly, if you wish) schedule: every alternate Sunday rather than every Sunday. I continue to enjoy writing Love of All Wisdom and intend to keep doing so, but as I have tried publishing more conventional papers, studying computer science and teaching a course on top of my day job, the weekly schedule has been too hard to sustain. I hope that alternating weeks will make it easier for me to continue engaging in the wonderful exchanges of ideas that have taken place here.

In Canada and the US today, the Christian aspect of Christmas is likely most noticeable in the music. There are of course a great number of English-language Christmas songs with little or no Christmas element (“Jingle Bells”, “Deck The Halls”, “Frosty The Snowman” and so on). It is increasingly common to hear only these songs played in public places. But one may quickly feel something missing here. Certainly some of these songs are grander than others; it would be a difficult task indeed to argue that “Deck The Halls” is no better a work than “I Saw Mommy Kissing Santa Claus”. But even so, there is a certain depth that is missing from them.

By contrast, many Christian carols engage with some weighty theological questions, especially that most significant of all questions for monotheistic believers: theodicy, the problem of bad. If there is a God – specifically, a being both omnipotent and omnibenevolent – how can the world be so full of terrible things? Continue reading →

In previous years I’ve insisted that Christmas has a significance and value to North American life well beyond Christianity. It is a ritual that brings families together – something Confucius would say is among the most important things in the world, irrespective of anything such rituals might mean. And its meaning is not limited to Christian stories; it is also a seasonal festival of light and darkness, of the winter solstice.

I stand by all of that. But having said it, I think that for secular North Americans (and likely Europeans as well) there is also considerable value in the specifically Christian meaning of the festival. Continue reading →

baby KrishnaI cannot think very long about aesthetics without encountering the concept of kitsch. Perhaps doubly so now in the Christmas season (on which more in coming weeks), but in the rest of the year at all. One of the reasons I haven’t thought that much about aesthetics, I realize, is that I suspect most modern thinkers on the subject would consider many of my favourite artistic creations bad art – if they would consider them art at all. And the concept which would typically be used to describe them is kitsch: works with a lower-class popular appeal.

Among my favourite works of music are several power ballads of the late ’80s and early ’90s, which I enjoy non-ironically. In visual art, I love the bright Indian aesthetic in its popular manifestations: poster art of deities, temples covered in “Christmas” lights. Continue reading →

Last week I examined the theology of Marcion of Sinope, who believed – as did many other early Christians – that there existed two gods, one good and one evil. I argued that Marcion’s theology is an ingenious way for a Christian to make sense of the atrocities in the Hebrew Bible. But this week I want to argue that the appeal of such a theology goes well beyond the interpretation of scripture in the West. Rather, it is also a way to help us understand the world, if we are to take theism seriously. Continue reading →

For Augustine, evil is nothing more than the absence of good, as we would say cold is no more than the absence of heat. Not every contemporary Christian follows this idea exactly, but the majority would surely agree that the goodness of God is supremely powerful, with evil (whether personified as Satan or not) significantly lesser.

It was not always this way. Many early Christian factions – most famously the Manicheans, but also the Marcionites and many Gnostics – believed that there were two warring gods, one good and one evil. Continue reading →

I’ve been spending some time lately with James Doull‘s last essay, “Hegel’s Phenomenology and post-modern thought”, and also with his closely related address on “Heidegger and the state”. (Both are in Philosophy and Freedom, the only published book of Doull’s writings.) Doull’s project in the Hegel essay is in a sense meta-Hegelian: to situate Hegel‘s thought in a philosophical history, as Hegel himself would do with the thinkers before him.

So the first parts of the essay tell the story of premodern and modern Western thought as it leads up to Hegel – a fine exegesis. But it’s the latter part of the essay that gets really interesting. For of course the history of philosophy went on after Hegel – and how should a Hegelian deal with that? Continue reading →

Last week I discussed the first reason you can read my dissertation on this site, and said that this week I would talk about the second reason. But I’m going to put that off until next week, to speak this week of a current event.

Pope FrancisI refer, of course, to the election of Jorge Mario Bergoglio as Pope Francis. The selection of a pope is a philosophically significant event, for a pope is in some respects among the modern age’s closest equivalents to a philosopher-king: a man trusted by millions or even billions of people to decide the truth about ultimate reality and what is good. And the selection of this pope in particular seems to me an excellent one, a man much better suited for this role than I expected him to be. Continue reading →
